General Terms and Conditions (GTC) 

§ 1 Scope of application, customer information 

The following General Terms and Conditions (GTC) govern the contractual relationship between ax-lightness composites GmbH and consumers who purchase goods through our shop BENObikes. The contractual language is German. 

§ 2 Conclusion of contract 

(1) The offers on the Internet represent a non-binding invitation to you to purchase goods. 

(2) You can place one or more products in the shopping basket. In the course of the ordering process, you enter your data and wishes regarding the method of payment, delivery modalities, etc.. Only when you click on the order button do you make a binding offer to conclude a purchase contract. You can also place a binding order by telephone.

The presentation of the products in the online store does not constitute a legally binding offer, but an invitation to place an order. By clicking on the "Buy" button, you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of the order follows immediately after the order is sent and does not constitute acceptance of your offer. The purchase contract is concluded when your order is accepted by sending the order confirmation by e-mail or by delivery of the goods within 2 working days.

(3) We are entitled to accept the offer made via the Internet within 2 working days by sending an order confirmation by e-mail. After the fruitless expiry of the period referred to in sentence 1, your offer shall be deemed to have been rejected, i.e. you shall no longer be bound by your offer. In the case of an order placed by telephone, the purchase contract shall be concluded if your offer is accepted by us immediately. If the offer is not accepted immediately, you are no longer bound by it.

§ 3 Customer information:

Storage of the contract text Your order with details of the concluded contract (e.g. type of product, price, etc.) will be stored by us. We will send you the general terms and conditions, but you can also access the general terms and conditions at any time after conclusion of the contract via our website. As a registered customer, you can access your past orders via the customer log-in area (My Account). 

§ 4 Customer information:

Correction notice You can correct your entries at any time before placing the order by pressing the delete key. We will inform you of further correction options as you proceed through the ordering process. You can also exit the order process completely at any time by closing the browser window.

§ 5 Statutory liability for defects and limitation period 

(1) Liability rights for defects Statutory liability rights for defects exist for our goods. 

(2) Limitation of liability for defects (warranty) for used goods There are two periods for your claims for defects, both of which run from the delivery of the used goods to you. We reduce the liability period for defects from two years to one year.

However, you can assert claims for defects that occur within this liability period until the expiry of the statutory limitation period of two years. Excluded from the shortening of the liability period are claims for damages, claims due to defects which we have fraudulently concealed, and claims arising from a guarantee which we may have assumed for the quality of the item. The statutory periods shall apply to these excluded claims. In the event of a guarantee period, the longer period shall apply in favour of the guarantee recipient. 

§ 6 Voluntary warranty extension 

Carbon components (frames, framesets, handlebars, seatposts, etc.) of the BENOTTI and ax-lightness brand: ax-lightness composites GmbH grants the original purchaser a six (6) year warranty from the date of purchase on the structural integrity of frames or framesets for the original purchaser. A frameset is a BENOTTI brand frame equipped with a BENOTTI brand rigid fork. Shock absorbers, suspension forks and suspension parts do not fall under the definition of a frame or frameset. The bearings on full-suspension frames and damage to the paintwork are also excluded.

The BENOTTI brand aluminium bicycles are excluded from the 6 (six) year warranty.

The above 6 (six)-year warranty does not apply to damage caused by improper or inappropriate use as described on our website for the respective product, such as neglect of the product (inadequate care and maintenance), modifications to the frame or fork (e.g. engravings or paintwork), attachment and conversion of additional components not expressly approved by us or replacement of the components installed by us on delivery with components of a different type, falls, overloading, jumps or other types of overloading.

ax-lightness composites GmbH reserves the right to limit the warranty service to the country in which the product was purchased. We will repair defective frames or forks or replace them with a suitable successor model. Replacement with a successor model may be necessary as we cannot keep unlimited stocks. In any case, we will endeavor to provide a product that is as similar as possible to the original product.

Other components and products of the BENOTTI and ax-lightness brand and all third-party components (e.g. suspension elements, brakes, rear derailleurs) are not covered by this warranty. However, a specific warranty from the third-party manufacturer may apply. Information on this can be found on the third-party manufacturer's website.

§ 7 Limitation of liability 

We exclude liability for slightly negligent breaches of duty insofar as these do not relate to material contractual duties, damage arising from injury to life, limb or health, guarantees or claims under the Product Liability Act (ProdHaftG). The same applies to breaches of duty by our vicarious agents and our legal representatives. Essential contractual obligations include in particular the obligation to hand over the item to you and to provide you with ownership of it. Furthermore, we must provide you with the item free of material defects and defects of title. 

§ 8 Consumer information: 

Non-participation in dispute resolution proceedings We are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.
